New Law Requires CPR Certification and First Aid Certification for Child Care Providers in NYS

AN ACT to amend the social services law, in relation to requiring at least one employee of any child day care facility to be trained and and complete the CPR certification cardiopulmonary resuscitation. Once completed the provider also has to complete the First Aid certification for children and infants THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS: Section 1.

Section 390-a of the social services law is amended by adding a new subdivision 5 to read as follows: 5. A. THE SITE PROVIDER OF A FAMILY DAY CARE HOME OR GROUP FAMILY DAY CARE HOME SHALL PROVIDE THAT AT LEAST ONE EMPLOYEE WHO HOLDS A VALID CPR CERTIFICATION. AFTER THAT THE PROVIDER MUST COMPLETE A VALID FIRST AID CERTIFICATION IN A COURSE OF STUDY IN FIRST AID CERTIFICATION KNOWLEDGE AND SKILLS AND CARDIOPULMONARY RESUSCITATION, CPR CERTIFICATION WITH AN EMPHASIS ON PROVIDING THAT AID TO CHILDREN, AS APPROVED BY THE COMMISSIONER OF THE OFFICE OF CHILDREN AND FAMILY SERVICES, BE ON PREMISES DURING THE OPERATING HOURS OF SUCH FAMILY DAY CARE HOME OR GROUP FAMILY DAY CARE HOME. B. THE SITE SUPERVISOR OF A SCHOOL-AGE CHILD CARE PROGRAM SHALL PROVIDE THAT AT LEAST ONE EMPLOYEE WHO HOLDS A VALID CPR CERTIFICATION. AFTER THAT THE PROVIDER MUST COMPLETE AND A VALID FIRST AID CERTIFICATION IN A COURSE OF STUDY IN FIRST AID KNOWLEDGE AND SKILLS AND CARDIOPULMONARY RESUSCITATION (CPR CERTIFICATION AND FIRST AID CERTIFICATION) , WITH AN EMPHASIS ON PROVIDING THAT AID TO CHILDREN, AS APPROVED BY THE COMMISSIONER OF THE OFFICE OF CHILDREN AND FAMILY SERVICES, BE ON PREMISES DURING THE OPERATING HOURS OF SUCH SCHOOL-AGE CHILD CARE PROGRAM. C. THE DIRECTOR OF A CHILD DAY CARE CENTER SHALL PROVIDE THAT AT LEAST ONE EMPLOYEE WHO HOLDS A VALID CPR CERTIFICATION. AFTER THAT THE PROVIDER MUST COMPLETE A VALID FIRST AND CERTIFICATION IN A COURSE OF STUDY IN FIRST AID CERTIFICATION KNOWLEDGE AND SKILLS AND CARDIOPULMONARY RESUSCITATION, CPR CERTIFICATION WITH AN EMPHASIS ON PROVIDING THAT AID TO CHILDREN, AS APPROVED BY THE COMMISSIONER OF THE OFFICE OF CHILDREN AND FAMILY SERVICES, BE ON PREMISES DURING THE OPERATING HOURS OF SUCH CHILD DAY CARE CENTER. S 2. This act shall take effect on the one hundred twentieth day after it shall have become a law; provided, however, that effective immediate ly the amendment, addition, and/or repeal of any rule or regulation necessary for the timely implementation of this act on its effective date is hereby authorized and directed to be made on or before such effective date.
